ACKNOWLEDGEMENT AND ACCEPTANCE
These websites LE Staff Shop and any customised versions of such “Websites” are owned by Leading Edge Group Limited (ACN 093 019 213) and its affiliates and subsidiary entities “Leading Edge”. These are the current terms and conditions. They replace any other terms and conditions for the Leading Edge Group website published on the Leading Edge Appliances websites to date. The words “website” or “site” should be read as plural as applicable to accommodate the customised versions under the same terms and conditions.

By using this Website, you agree to the Terms and Conditions below (Terms and Conditions) and acknowledge that you have read and understood and agree to be bound by these Terms and Conditions.

The Seller may amend these Terms and Conditions from time to time without notice. Your continued use of this Website after any amendment becomes effective constitutes an agreement by you to abide and be bound by these Terms and Conditions, as amended. You acknowledge your obligations to keep yourself apprised of the Terms and Conditions as they change, modify or update.


1. DEFINITIONS

For the purposes of understanding these Terms and Conditions:
• “Buyer” shall mean the user of this site who shall be an employee of the Company that provides Staff Shop, or anyone that they purchase on behalf of.
• “Seller” shall mean Staff Shop.
• “3rd Party Seller” shall mean a business other than Staff Shop that advertises its goods or services on the Staff Shop site for sale.
• “Company” shall mean the organisation within which the Buyer is employed.
• “Manufacturer” shall mean the original producer of the goods purchased on the Staff Shop website.


2. PURCHASES

Only eligible employees notified to Staff Shop by the Company that holds this contract may make purchases on this website. To make a purchase, the buyer must:
a. Be a current employee* at the time of the purchase.
b. Use a valid credit card as accepted by Staff Shop.
c. Use a valid credit card that corresponds with the user’s name.
d. Provide details of a related delivery address in Australia that is not a post office box.
e. Conform with the Company’s policy on delivery of purchases to Company addresses.
f. Accept all responsibility for any or all purchases made in their name on this site.
*A Current employee is one who, irrespective of their contract type, holds an email account associated with the Company. By written agreement with the Seller, the Company may include long-serving consultants or retirees whose email address varies from the Company.


3. RETURN, REFUND, OR EXCHANGE POLICY

Please read the following terms and conditions carefully before proceeding with a return, refund, or exchange request. Terms & Conditions – LE Staff Shop. By initiating a return, refund, or exchange, you acknowledge and agree to comply with the terms outlined below:
a. Eligibility for Return, Refund, or Exchange:
A return or refund may occur under the following circumstances:
i. The item received by the buyer does not match the listing as per 3(d).
ii. The item is not received by the buyer as per 3(e).
iii. The item is not authentic as per 3(f).
b. Change of Mind:
This policy does not cover change of mind. We do not accept returns, refunds, or exchanges based on personal preferences or change of mind.
c. Notification and Claim Process:
i. To qualify for consideration for a return, refund, or exchange, the buyer must notify Staff Shop directly within 14 days of receipt of the purchase. All notifications must be via Contact – LE Staff Shop where you should select replace or refund from the options provided.
ii. The claim must include the following information:
(a) The name, email, address, and contact phone number of the buyer.
(b) A description of the item purchased.
(c) The date of purchase.
(d) The item receipt number.
(e) The purchase price, including shipping and insurance.
(f) The reason for the return, refund, or exchange claim.
d. Item Received by the Buyer That Doesn't Match the Listing:
An item received by the buyer that doesn't match the listing refers to:
i. Clearly looking or being different from the item listed.
ii. Arriving broken or damaged.
iii. Arriving and not working.
e. Item Not Received by the Buyer:
An item not received by the buyer is one that can be proven to have been dispatched to the correct address by the seller as directed by the buyer.
i. seller can verify that the item has not been signed for on delivery by the buyer.
ii. The seller can verify that they used a recognised delivery service with a verified tracking number.
f. Item Deemed Not Authentic:
i. An item received by a buyer is deemed not to be authentic when the buyer suspects the item is a fake, replica, copy, or misrepresentation of a brand name or Purchaser.
ii. The buyer can prove that the item is not authentic through the provision of a letter from a recognised expert in identifying fake, copied, or replica goods.
g. Seller's Responsibility and Legal Consequences:
i. Any seller who knowingly sells a fake, copy, or replica item may be in breach of the Trade Marks Act (1995) or the Copyright Act (1968).
ii. Staff Shop will report any suspected breach to the appropriate authorities for their determination and action.
iii. Staff Shop will immediately stop advertising and will remove from sale any items found to be fake, copied or replica and this condition will prevail until otherwise proven.
h. Agreed Return:
i. Items must be returned in the original condition (unused) and in the original packaging.
ii. The seller will provide a return address to the buyer.
iii. All shipping return charges are to be covered by the seller.
iv. All returned items must be insured for loss during shipping.
v. All returned items must use a recognised delivery service nominated by the seller, with a verified tracking number shared by the buyer with the seller.
vi. The transaction between the buyer and the seller will be reversed by Staff Shop upon the settlement of the issue, including any costs for insurance and shipping.


4. WARRANTY REPAIRS

For certain goods, (for example but not limited to) like large white goods and similar items, warranty repairs may need to be handled directly with the manufacturer. Please review the following clauses regarding warranty repairs:
a. In the case of large white goods and other items specified by the Seller, the manufacturer is responsible for handling warranty repairs. This means that if you encounter any issues or defects covered by the warranty, you will need to contact the manufacturer directly for assistance.
b. The contact details of the manufacturer, including their customer support or warranty department, will be provided to you either:
i. at the time of purchase;
ii. included in the product documentation; or
iii. by the Support team at Staff Shop when lodging an enquiry via https://le.staffshop.online/support.
It is essential to keep this information readily available for future reference.
c. The warranty terms and conditions for the specific product is provided by the manufacturer. It is important to carefully review and understand the warranty coverage, limitations, and any applicable terms or requirements.
d. If warranty repairs are necessary, the manufacturer or Staff Shop may provide instructions on returning the item for repair. Please note that any associated shipping costs or transportation arrangements for returning the item to the manufacturer will be the customer's responsibility, unless otherwise stated by the manufacturer.
e. The manufacturer will have their own repair process and procedures in place. This may include diagnostic assessments, repair timelines, and any necessary communication or documentation exchange. The manufacturer will communicate with you directly to guide you through their specific repair process. Staff Shop has no control or responsibility for any products involved in this assessment, repair and return process of the manufacturer’s.
f. Throughout the warranty repair process, it is important to maintain open communication with the manufacturer. They will provide updates on the repair progress, estimated timelines, and any other relevant information. It is advisable to retain copies of all communication and documentation related to the warranty repair.
g. While warranty repairs for large white goods and similar items are handled directly by the manufacturer, our customer support team is available to assist and provide guidance. If you have any questions or concerns regarding the warranty process or need general assistance, please feel free to contact us. We will do our best to provide any available support or facilitate communication between you and the manufacturer.
By proceeding with the purchase of large white goods or specified items, you acknowledge and accept the need to liaise directly with the manufacturer for any warranty repairs as outlined in this clause.

 

5. REFUNDS

a. After inspecting your goods, if we determine that a remedy is not applicable, such as in cases where we believe the goods have been misused, used contrary to the manufacturer's instructions, used in an abnormal manner, or not taken reasonable care of, we will reject your claim and return the goods to you. Please note that if we have rejected your claim upon inspection, you will be responsible for covering the cost of return shipping in order to receive the goods back. We will provide you with detailed instructions on how to make this payment for the return shipping costs. You may elect not to have the goods returned and no further charges will be levied against you.
b. Refunds will be issued through the original payment method used for the purchase. We can organise a replacement if available at no further cost to you in lieu of a refund. We do not have the facility to issue a credit to your account at this time.
c. We strive to process refunds and replacements within 28 days of receiving the original product. However, please note that the processing time may vary depending on the item and the number of returns in our system. Rest assured, we will make every effort to expedite the process and keep you informed along the way.
d. If the goods and/or services you have purchased are redeemable through a third-party provider, please note that a refusal of refund or replacement from us does not impede your ability to pursue a refund directly from the provider. We encourage you to contact the third-party provider for further assistance in such cases.


6. USER AGREEMENT

a. By accessing and using the Staff Shop website ("website"), you acknowledge and agree to abide by the terms and conditions outlined in this Agreement and our Privacy Policy. This Agreement is a legal agreement between you and Staff Shop. We reserve the right to modify these terms at any time, and any updates or revisions will be posted on the website. Your continued use of the website after such changes signifies your acceptance and compliance with the modified terms.
b. Access to this site is predicated by your employment with the Company under which Staff Shop has been engaged. Staff Shop is not responsible for any outcomes or changes to your access or permissions caused by changes in your Company’s policies, procedures or management of their contract with Staff Shop.


7. SPECIFIC TERMS APPLICABLE TO MARKETPLACE SALES

a. At Staff Shop, we not only provide our own goods and services but also operate as a marketplace platform that enables us to select and sell independent and third-party products on our website. These sellers have been carefully selected to ensure they meet our standards of quality and reliability. Staff Shop offers a diverse range of products supported by an intended seamless shopping experience. We believe in fostering a trusted marketplace where both sellers and buyers can connect and transact securely. By purchasing these goods, you are transacting directly with Staff Shop using the Staff Shop e-commerce platform.
b. We rely on our 3rd party sellers to provide Staff Shop with an accurate and valid description of the goods and services used to advertise on the Staff Shop website. Staff Shop therefore takes no responsibility for the accuracy, quality and content used in the transaction. If you believe that the item purchased has been poorly described or misleading in its description, you should contact us via Contact – LE Staff Shop having first identified what part of Clause 3 of this Agreement you wish to apply.
c. In addition to outlining the terms and conditions that apply to the goods we sell, these terms also encompass the terms that govern goods sold by third-party sellers.
d. As a platform facilitating transactions with independent sellers, we want to clarify that we cannot be held accountable for the seller's goods or services, to the extent permitted by law. Staff Shop does not provide any warranty or representation regarding the quality of goods or services offered by the 3rd party seller. It is important to note that nothing in this clause is intended to limit or modify your rights or our obligations that cannot be restricted or modified by law, including the provisions of the Australian Consumer Law.


8. REGISTRATION AND USER REQUIREMENTS

a. To access certain features of the website or our services, it is required that you are a current employee of the contracted company. Upon your initial login, you will be requested to provide us with accurate and up-to-date personal information, including your name, address, and a valid email address that is connected to your company (i.e., the work email that your company issues you on engagement). It is essential that you ensure the accuracy and currency of this information.
b. Your employer uses pay cycles to notify Staff Shop of new and existing employees and their email addresses. Staff Shop will add and subtract these employees within 3 working days of the receipt of this information, during which time a new employee will not have access. Once the employee has been registered in the system using the Company-provided report, they will be notified by Staff Shop on their work email to activate their account.
c. By utilising the website and its associated functionality, you explicitly consent to receiving direct marketing communications at the email address you provide. However, you have the option to unsubscribe from these communications at any time. Your consent to receive specific communications may be implied using certain functional features of our service, such as receiving reminders about items in your shopping cart if you happen to leave the page during a transaction.
d. As a user you will be given the opportunity to set up your own password. You must follow the requirements to create a valid password and then use your best endeavours to protect this password. You remain responsible for your password’s security and Staff Shop and your Employer take no responsibility for misuse of your password by another person.


9. ACCESS AND USE OF THE WEBSITE

a. You are required to use the website solely through the interfaces provided by us, and your usage must align with these terms and any applicable laws.
b. You are strictly prohibited from engaging in the following activities:
i. Interfering or attempting to interfere with our site or the servers or networks hosting our site, causing disruption.
ii. Using or attempting to use data mining, robots, screen scraping, or similar tools to gather and extract data from our site.
iii. Interfering or attempting to interfere with security-related or other features of our site.
iv. Using, copying, or distributing content without obtaining our explicit permission.
v. Allowing direct access by persons other than yourself by the sharing of your email and passwords.
c. We reserve the right to report any fraudulent, abusive, or illegal activities to the appropriate authorities. As the account holder, you are solely responsible for all activities conducted on your account, including any orders placed. It is your responsibility to maintain the security of your account password. We cannot be held liable for any unauthorised activity on your account if you fail to keep your login information secure.
d. You are strictly prohibited from using another user's account without explicit permission from us and/or the account owner. If you suspect or become aware of any unauthorised use of your account or if you believe that your password is no longer secure, it is your responsibility to notify us immediately via the “forgot your password” feature on the login page. A link to resetting your password will be provided to your work email account. You must take immediate action to secure your account through your new password.
e. We cannot guarantee uninterrupted and continuous availability of the website, and we make no warranties regarding the content of any other websites linked to or from our website.
f. We reserve the right to modify or terminate an account or your account details at our absolute discretion, and/or orders where the information provided is discontinued or obsolete, incomplete, illegal, incorrect, misleading, inactive for a reasonable period, or we have not been able to contact you using the information provided with your account, and/or where we believe your account is being used for purposes that do not comply with these Terms of Order or the Terms and Conditions of use of our Site.


10. CONTENT ON THIS WEBSITE

a. Much of the information about goods on the website is sourced from third-party Sellers, suppliers, and/or product manufacturers. While we make every effort to ensure accuracy, we cannot be held liable for any inaccuracies or errors resulting from incorrect information provided to us by these third parties, unless required by law (including the Australian Consumer Law).
b. It is your responsibility to conduct your own inquiries and verify the information provided to determine the suitability of goods or services before placing an order.
c. Please note that due to limitations in photography and screen representation, there may be minor variations in the visual appearance of certain goods (such as clothing, apparel, and shoes) compared to their depiction on the website. Additionally, in some cases, promotional images of products or services may be used for illustrative purposes and may not precisely reflect the actual product or service received.

A price change will not impact on any financial transaction already concluded but not yet fulfilled.

b. You agree to use this site only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this site by any third party.


13. PLACING ORDERS

a. You are solely responsible for any discrepancies or errors in your order that are caused by your own actions.
b. The promotion of goods or services on the website is not a binding offer to sell. It is solely an invitation to treat.
c. When you place an order, you are making an offer to purchase goods under the terms and conditions specified in this Agreement, including the specified price, delivery charges, and any other applicable charges.
d. Goods sold by Staff Shop are not reserved in your shopping cart, and the order is finalised only when you complete the checkout process, receive an order confirmation from us, and make full payment for the order.
e. When you place an order for goods, we will forward the order to the Seller for confirmation. The Seller has the option to accept or reject your order. In the event of a rejection, we will promptly refund you for the order and any applicable shipping charges. You will receive an email notification confirming the acceptance of your order by the Seller.
f. To ensure a secure shopping experience, we employ automated fraud detection software. In some cases, this may lead to delays or cancellations of orders. If your order is flagged for fraud detection, we will conduct necessary investigations to assess the potential fraud. Please note that we reserve the right to reject and refund your order at our sole discretion if fraudulent activity is suspected.
g. You must review your order carefully before placing it. Once an order is confirmed, you are unable to cancel or change it. If you have any problems with your order, then you must go through the normal returns process outlined in this Agreement. If you change your mind, you can return your goods provided you meet the requirements set out in our Return, Refund, or Exchange Policy in clause 2.
h. If, for any reason, we are unable to fulfill or need to cancel your order, rest assured that we will promptly provide a full refund for any payment you have made. Your satisfaction is our priority, and we strive to ensure a seamless shopping experience.
i. We understand that circumstances can arise beyond our control, resulting in the unavailability of goods you have ordered. In such cases, we reserve the right to notify you promptly. Your order may experience a delay, or you may opt to receive a full refund or store credit, depending on your preference, if we are unable to fulfill your order.


14. PRICING POLICY

Prices and offers are subject to change without notice. The price for goods bought from this website may be lowered after your order has been accepted and payment processed. We reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and payment for the order made. Advertised “Online Only” specials and promotions are only available via purchases made on this Website. Leading Edge Appliance store members may or may not price match offers made on this website at their sole discretion.


15. PRICE AND PAYMENT

a. All prices displayed for goods, delivery, and additional charges are stated in Australian dollars.
b. Full payment must be made before the goods are dispatched. If your payment is not received or is declined by us, your bank, or credit card issuer, we cannot and will not reserve items for your order.
c. This site currently operates so that it accepts payments for your order using specific payment methods that are outlined at checkout.
d. Payment providers may change from time to time and without notice.
e. Payment processing services offered via the Site are outsourced to third party providers. If we do not receive or are unable to successfully process payment in full for your order for any reason, we will cancel your order.
f. Where we choose to use third-party services in conjunction with this Site, including secure payment options for purchasing goods from the Site, you may also be required to create and maintain a separate account that may include Personal Information and financial account details.
g. You must comply with the terms of use and privacy policies of such third-party websites and should review the relevant third party provider’s target market determination before use. Non-compliance with these third-party websites may limit your ability to order, be provided with goods, rebates or bonus offers in conjunction with your purchase.
h. If you choose to pay by a credit card or debit card, you authorise us to debit the amount that is payable for an accepted order from your nominated card. You will be required to provide us with the following details on your credit card or debit card: card type, name on card, card number, 3 or 4-digit card verification value (CVV) and the card expiry date.
i. You must not pay, or attempt to pay, for products or services through any fraudulent or unlawful means. Your arrangements and obligations with respect to your purchase of the product/s and/or services remain with the Leading Edge Appliances which is set out on the tax invoice you receive with your ordered product/s and/or services, including product warranties and servicing.


16. ORDER ACCEPTANCE

a. After you place an order using our shopping cart, we will check the information you give us for validity, by verifying your method of payment or shipping address. We reserve the right to reject any order you place with us for any reason whatsoever. If we reject your order, we will attempt to notify you using the e-mail address or contact phone number you have given us with the order. Your credit or debit card will normally not be charged if we reject an order, but we will process a refund if the charge has been made against your card. Refunds or reversals can only be made against the card used in the initial transaction.
b. The availability of products and services on this Site are subject to change without notice. No commitment to stock availability is made on our Site.


17. ORDER LIMITATIONS

a. We reserve the right to reject any order you place with us, and/or or to limit quantities on any order, without giving any reason. These restrictions may include orders placed by the same account, the same credit card, and orders that use the same billing address. In the event we reject an order, make a change to an order, or limit an order we will attempt to notify you by contacting the e-mail and/or billing address provided at the time the order was made. We reserve the right to limit or prohibit sales to dealers or any commercial enterprise. We will not accept an order where the billing address is a post office box.
b. If we are unable to supply all items listed on your order, these terms and conditions will apply to the supply of all or part of the order. We may backorder goods on your behalf if for any reason we are unable to supply any or all items listed on your order. Where a backorder has been placed on your behalf, we will contact you by phone or email following delivery of the backordered good at the nominated delivery address. All backorders are subject to stock availability with our supplier.
c. We reserve the right to cancel an order if you are unable to prove that you are the customer (or agent/representative of the customer) listed on the order, or if you are ineligible to purchase goods sold on the website due to age restrictions. We reserve the right to not provide stock if proof of purchase, identity or age cannot be produced. To comply with our legal obligations, you acknowledge that we may be required to retain a copy of any identification provided.


18. CANCELLING AN ORDER

Prior to dispatch of your order, you may cancel your order by using our Contact – LE Staff Shop. We reserve the right to charge an administration fee to cover our reasonable costs in respect of your cancelled order. If your order has been dispatched, we cannot cancel your order.


19. ADVERTISED PRICE DISCLAIMER

a. To the extent permitted by law, the following disclaimers apply with respect to prices and offers:
i. Prices and offers are subject to change without notice.
ii. Some pricing will reflect delivery as part of the overall cost. This may create a differential when purchasing from a store as opposed to a direct ship purchase from the website.
iii. We reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and payment for the order made.

20. INTERNATIONAL SELLERS

a. When purchasing goods from third-party Sellers based in overseas countries and importing them into Australia, you may be subject to compliance with Australian laws and standards that are applicable to the importation of such goods.
b. For certain products or orders from overseas Sellers that exceed the low-value import threshold (currently AUD$1,000.00), you may be required to pay an additional duties and taxes collected by the Australian Customs and Border Force. 21. SHIPPING AND DELIVERY

a. The goods will be supplied as specified in your order confirmation, which will be sent to you via email, subject to the terms and conditions of this Agreement.
b. While we strive to meet the stated delivery timeframes, please note that our shipping service providers may experience occasional delays, especially during peak periods, which are beyond our control. We appreciate your understanding and patience. For standard and express shipping, please allow up to 30 days for delivery. • Check for obstacles along the path to the hook up location. Is the path clear? Will the appliance fit through the front door?
• Verify that an unloading zone is available within 7m of the home for parking and access.
• Verify that there is an elevator or less than 3 steps to get to the delivery location.
• You will be required to present your proof of purchase and photo ID upon delivery.
• Inspect your new appliance for any visible damage. Notify the delivery driver of any damage at time of delivery.
• Verify that supporting services required to run your product are in working order.
• We do NOT carry bulky items up spiral staircases. Bulky deliveries will be brought inside, up to the bottom of the staircase.

When returning storage media to us like a hard disc drive for any reason including replacement or repair, it is important to note that we cannot be held responsible for any software or data stored on the media. While we strive to provide the best service possible, we cannot guarantee that we will be able to repair or replace the product without any impact on the software or data.


25. DEFECTIVE GOODS
